Haramcin Hukuma ne ko na Shari’a

Matsalolin da Allah (s.w.t) ya kawar wa dan Adam ta hanyar ba shi mafita suna da yawa sai dai shi dan Adam ne ya toshe wadancan kofofin da Allah ya bude masa, sakamakon kauce wa mafitar da Allah madaukaki ya ba wa dan’adam ne barna da fasadi suka yawaita a duniya. Mutum yana kama da mota ce da mai ita ya kera sai ya ba shi mafita da inda zai sanya fetur, da wurin ruwa, da na bakin mai. Idan ya ki yarda da wadannan dokokin to zai ga ba daidai ba a motarsa. Wadanda da suka saba wa hukuncin Allah suka shafe shi babu wani dalili sai ga shi suna hauma-hauma sun rasa madafa.
Jabir dan Abdullah yana cewa: “Mun yi auren mutu’a lokacin manzon Allah (s.a.w) da lokacin Abubakar da wani bangare na lokacin Umar, sai Umar ya ce: Kur’ani dai shi ne Kur’ani, Manzon Allah dai shi ne manzon Allah, kuma dai wadannan mutu’o’in guda biyu ne da suke lokacin manzon Allah (s.a.w), wato hajjin tamattu’i, da kuma auren mutu’a” . Sai dai a nan Ahmad bn Hambal ya cire karshen maganar ne, domin Umar yana cewa: Ni na hana ne kuma ina yin ukuba a kan duk wanda ya yi su .
Jabir dan Abdullah al’Ansari ya bayar da amsa yayin da labarin jayayyar Abdullahi dan Zubair da Abdullahi dan Abbas ta zo masa game da auren mutu’a da hajjin tamattu’i, sai Jabir ya ce: Mun yi su a lokacin manzon Allah (s.a.w) sannan sai Umar ya hana su, ba mu koma muna yin su ba .
Suyudi yana cewa: “Farkon wanda ya hana auren mutu’a shi ne Umar” .
Jabir dan Abdullah yana cewa: “Mun yi auren mutu’a lokacin manzon Allah (s.a.w) da lokacin Abubakar, da wani bangare na lokacin Umar, sai Umar ya hana” .
Mash’huriyar maganar Imam Ali (a.s) ta shahara cikin musulmi cewa: “Ba don Umar ya hana auren mutu’a ba, da babu wanda zai yi zina sai ya tabe”. Wasu suna fassara shi da cewa: “Ba don Umar ya hana auren mutu’a ba, da babu wanda zai yi zina sai tababbe” .
Malaman Sunna da Shi’a sun yi ittifaki a kan cewa; Zina ta yawaita cikin al’ummar musulmi ta yadda ta shiga kowane lungu da surkukiya domin wannan hanin da Umar ya yi wa auren mutu’a.
Wasu mutane sun yi kokarin ganin sun dora wannan haramci kan manzon Allah (s.a.w) domin su gyara wannan haramci, sai dai dukkaninsu ruwayoyi ne da suka rushe saboda sun ci karo da ayar Kur’ani da ta halatta shi, da kuma karo mai karfi da suka yi da tarihin da yake hannun musulmi baki daya mai nuni da abin da ya faru na cewa: Halifa na biyu Umar dan Khaddabi shi ne ya haramta auren Mutu’a!.
Duniyar musulmai ta yi ittifaki a kan auren mutu’a ya halatta daga Allah da manzonsa, kuma sun yi ittifaki kan cewa Umar dan Khaddabi ne ya shafe shi. Don haka ne muke son tambayar wadanda suke ganin ya shafu har abada kan cewa: Shin Wannan Haramcin na Hukuma ne Ko na Shari’a?
Domin idan Umar ya haramta ne a matsayinsa na jagoran musulmi saboda wani yanayi sai haramcin ya kasance saboda wannan matsalar ta dan wannan lokacin ne kawai, musamman abin da wasu suke kawowa na cewa; ‘ya’yan Mutu’a ne suka yi yawa, kuma Baitul-mali ce take ciyar da su, sai wannan lamarin ya yi wa halifa Umar zafi kan cewa don me iyayensu ba su dauki nauyin su ba! A nan ke nan akwai nuni da cewa ba haramcin shari’a ba ne domin haramcin shari’a yana faruwa ne ta hanyar wahayi daga Allah madaukaki!.
Idan kuwa ya haramta ne saboda maganar Ibn Hurais ne wanda halifa Umar ya kira shi da “Auren Sirri”, to shi ma yana nan kan maganar da muka kawo ne na cewa wannan hanin nasa ba na shari’a ba ne na hukuma ne, don haka sai ya takaita da wancan lokacin. Hada da cewa a wannan lamarin babu wani nuni da cewa akwai wani dalili sai na cewa Halifa yana ganin sa a matsayin Auren Sirri!.
Amma idan kuwa haramcin da ya yi masa na shari’a ne, to babu wani wanda yake iya shafe hukuncin Allah da manzonsa ko da kuwa yana da matsayi babba a masulunci kamar halifa. Don haka haramcin hukuncin Allah da manzonsa yana bukatar wahayi, kamar yadda halascinsu yake bukatar hakan, ga shi wahayi kuwa ya yanke da wafatin manzon rahama (s.a.w).
Wayo A Shari’a
A yau zamu ga musulman da suka yarda da wancan haramcin sun fada cikin bala’in kaiwa ga makura, sai suka fara kame-kame. Sun san cewa irin kawance da abota tsakanin maza da mata da ke faruwa a yammancin duniya wanda yakan kai ga saduwa barkatai dai haram ne don haka ba zai yiwu ba, kuma sun haramta Auren Mutu’a shi ma ba zasu yi ba!. Sakamakon haka ne suka kirkiro wani aure mai suna “Auren Misyar” domin su rage kaifin zinace-zinace da fasikanci da ya gallabi al’ummarsu, shi aure ne da kasashe kamar Saudiyya suka zartar da shi hatta da a cikin kundin tsarin kasarsu.
“Auren Misyar” aure ne wanda yake ba a ambaci iyaka ba, sai dai an saryar da wasu abubuwan da aka saryar da su a Auren Mutu’a kamar wajabcin ciyarwa, da bayar da wurin zama, sai dai yana da saki, da gado, da sauran hukunce-hukuncen Aure Da’imi.
Abin mamaki a nan shi ne waye ya ba wa wadannan malamai lasisin zartar da irin wannan auren bisa son rai alhalin sun toshe hanyar da Allah ya bude musu?!.
Don haka ne littafin Allah mai daraja yake cewa: “Ba komai bayan gaskiya sai bata”!.
